Terms of Service

  1. Acceptance of These Terms

    1. By accessing or using Surv (“the Service”), you agree to be bound by these Terms of Service (“Terms”).
    2. If you do not agree to these Terms, you may not use the Service.
    3. These Terms apply to all users, including survey creators, respondents, and visitors.

  2. Description of the Service

    1. The Service allows users to create, share, and respond to short surveys and questionnaires, and to distribute surveys via email, connected social media accounts, or webhook-integrated channels (e.g., Slack, Discord).
    2. Surveys may include one question with response types such as:
      • Multiple choice
      • Sliding scale
      • Ranked choice
      • Free-text responses

  3. Eligibility

    1. You must be at least 13 years old (or 16 where required by law) to use the Service.
    2. By using the Service, you represent that you meet this requirement.

  4. User Roles and Responsibilities

    1. Survey Creators

      1. You are responsible for the content of your surveys
      2. You agree not to request sensitive personal data unless legally permitted
      3. You will comply with applicable privacy and data protection laws
      4. You will use survey responses only for lawful purposes
      5. You will respect respondent privacy and expectations
      6. Survey creators are the owners of the responses they collect
      7. You are responsible for having appropriate permission to contact anyone you add to a contact list or mailing list, and for complying with applicable anti-spam and marketing laws (e.g., CAN-SPAM, CASL) when distributing surveys by email
      8. Connecting a third-party account (e.g., X/Twitter, LinkedIn, Facebook, Reddit) or webhook channel (e.g., Slack, Discord) to distribute surveys is subject to that platform’s own terms of service

    2. Survey Respondents

      1. Participation in surveys is voluntary
      2. Responses will be visible to the creator of the survey
      3. Respondents should avoid sharing sensitive personal information unless they choose to do so
      4. The Service is not responsible for how creators use responses outside the platform

  5. Acceptable Use

    1. You agree not to use the Service to:
      • Violate any laws or regulations
      • Harass, abuse, or harm others
      • Create deceptive or fraudulent surveys
      • Collect sensitive personal data without proper consent
      • Interfere with the Service’s operation or security
      • Attempt to bypass access controls or technical safeguards
    2. We reserve the right to remove content or suspend access for violations of these Terms.

  6. AI-Assisted Features

    1. The Service may include optional AI-powered features, such as:
      • Survey question suggestions
      • Bias or clarity review of questions
      • Aggregated summarization of responses
    2. By using AI-assisted features, you understand that:
      • AI outputs are suggestions, not guarantees
      • You remain responsible for final survey content
      • AI-generated results may be inaccurate or incomplete

  7. Intellectual Property

    1. Our Content

      1. All software, design, and platform functionality are owned by or licensed to Surv.
      2. You may not copy, modify, or redistribute the Service without permission.

    2. Your Content

      1. You retain ownership of surveys you create and responses you submit.
      2. You grant Surv a limited license to host, store, and display your content solely to operate the Service.

  8. Data and Privacy

    1. Your use of the Service is governed by our Privacy Policy.
    2. The Privacy Policy is incorporated into these Terms by reference.

  9. Service Availability

    1. We do not guarantee uninterrupted or error-free access to the Service.
    2. We may modify, suspend, or discontinue features at any time.

  10. Termination

    1. We may suspend or terminate access for violations of these Terms.
    2. Users may stop using the Service at any time.
    3. Survey creators may delete surveys and associated responses.
    4. Account deletion is a two-step process: your account is deactivated immediately upon request, with a grace period during which you may cancel. After the grace period, deletion is permanent and irreversible — see the Privacy Policy for details on what is deleted versus retained in de-identified form.

  11. Disclaimers

    1. The Service is provided “as is” and “as available.”
    2. We disclaim all warranties to the fullest extent permitted by law.

  12. Limitation of Liability

    1. To the extent permitted by law, Surv is not liable for indirect or consequential damages.
    2. Our total liability will not exceed the amount paid to use the Service, if any.

  13. Changes to These Terms

    1. These Terms may be updated from time to time.
    2. Continued use of the Service constitutes acceptance of updates.

  14. Governing Law

    1. These Terms are governed by the laws of the State of Illinois, United States of America.
