Acceptance of These Terms
- By accessing or using Surv (“the Service”), you agree to be bound by these Terms of Service (“Terms”).
- If you do not agree to these Terms, you may not use the Service.
- These Terms apply to all users, including survey creators, respondents, and visitors.
Description of the Service
- The Service allows users to create, share, and respond to short surveys and questionnaires, and to distribute surveys via email, connected social media accounts, or webhook-integrated channels (e.g., Slack, Discord).
- Surveys may include one question with response types such as:
- Multiple choice
- Sliding scale
- Ranked choice
- Free-text responses
Eligibility
- You must be at least 13 years old (or 16 where required by law) to use the Service.
- By using the Service, you represent that you meet this requirement.
User Roles and Responsibilities
Survey Creators
- You are responsible for the content of your surveys
- You agree not to request sensitive personal data unless legally permitted
- You will comply with applicable privacy and data protection laws
- You will use survey responses only for lawful purposes
- You will respect respondent privacy and expectations
- Survey creators are the owners of the responses they collect
- You are responsible for having appropriate permission to contact anyone you add to a contact list or mailing list, and for complying with applicable anti-spam and marketing laws (e.g., CAN-SPAM, CASL) when distributing surveys by email
- Connecting a third-party account (e.g., X/Twitter, LinkedIn, Facebook, Reddit) or webhook channel (e.g., Slack, Discord) to distribute surveys is subject to that platform’s own terms of service
Survey Respondents
- Participation in surveys is voluntary
- Responses will be visible to the creator of the survey
- Respondents should avoid sharing sensitive personal information unless they choose to do so
- The Service is not responsible for how creators use responses outside the platform
Acceptable Use
- You agree not to use the Service to:
- Violate any laws or regulations
- Harass, abuse, or harm others
- Create deceptive or fraudulent surveys
- Collect sensitive personal data without proper consent
- Interfere with the Service’s operation or security
- Attempt to bypass access controls or technical safeguards
- We reserve the right to remove content or suspend access for violations of these Terms.
- You agree not to use the Service to:
AI-Assisted Features
- The Service may include optional AI-powered features, such as:
- Survey question suggestions
- Bias or clarity review of questions
- Aggregated summarization of responses
- By using AI-assisted features, you understand that:
- AI outputs are suggestions, not guarantees
- You remain responsible for final survey content
- AI-generated results may be inaccurate or incomplete
- The Service may include optional AI-powered features, such as:
Intellectual Property
Our Content
- All software, design, and platform functionality are owned by or licensed to Surv.
- You may not copy, modify, or redistribute the Service without permission.
Your Content
- You retain ownership of surveys you create and responses you submit.
- You grant Surv a limited license to host, store, and display your content solely to operate the Service.
Data and Privacy
- Your use of the Service is governed by our Privacy Policy.
- The Privacy Policy is incorporated into these Terms by reference.
Service Availability
- We do not guarantee uninterrupted or error-free access to the Service.
- We may modify, suspend, or discontinue features at any time.
Termination
- We may suspend or terminate access for violations of these Terms.
- Users may stop using the Service at any time.
- Survey creators may delete surveys and associated responses.
- Account deletion is a two-step process: your account is deactivated immediately upon request, with a grace period during which you may cancel. After the grace period, deletion is permanent and irreversible — see the Privacy Policy for details on what is deleted versus retained in de-identified form.
Disclaimers
- The Service is provided “as is” and “as available.”
- We disclaim all warranties to the fullest extent permitted by law.
Limitation of Liability
- To the extent permitted by law, Surv is not liable for indirect or consequential damages.
- Our total liability will not exceed the amount paid to use the Service, if any.
Changes to These Terms
- These Terms may be updated from time to time.
- Continued use of the Service constitutes acceptance of updates.
Governing Law
- These Terms are governed by the laws of the State of Illinois, United States of America.
